Step 1: Reconsideration

The first level of appeal is called Reconsideration.

• You must request it within 60 days of receiving your denial letter.
• A different SSA examiner (not involved in the original decision) will review your application, medical records, and any new evidence.
• You can submit additional medical documents or clarifying information at this stage.

The goal is to give the SSA a chance to review your case without needing a hearing.

Step 2: Hearing Before an Administrative Law Judge (ALJ)

If your reconsideration is denied, the next step is to request a hearing before an Administrative Law Judge.

• You must request the hearing within 60 days of your reconsideration denial.
• The hearing is usually held at the nearest Office of Hearings Operations (OHO) in Kansas or via video.
• You can present evidence, bring witnesses, and testify about your condition.

This is often the most critical stage of the appeals process and where many claimants are approved.

Step 3: Appeals Council Review

If the ALJ denies your claim, you can request a review by the SSA Appeals Council.

• The Council may uphold, reverse, or send your case back to the ALJ for a new hearing.
• They will only review your case if they find a legal or procedural issue.
• Not all requests for review are accepted.

Step 4: Federal Court Review

The final step is filing a lawsuit in U.S. District Court.

• This is a formal legal process and usually requires help from an attorney.
• A federal judge will review your case to determine if the SSA made a mistake in denying your benefits.

This step can take longer but may be necessary in some cases.
